1. Agreement to Terms

If you do not agree to these Terms, you must not download, install, or use the App. These Terms apply specifically to RentLink Mzansi. For our general organisational terms, please see our main Terms of Service.

2. Service Description

RentLink Mzansi is a rental property marketplace that connects landlords directly with tenants across South Africa and Botswana. The App enables:

• Landlords to list and manage rental properties, upload photographs and descriptions, and receive enquiries from prospective tenants.
• Tenants to browse and search rental properties, filter by location and criteria, and unlock landlord contact details to communicate directly.

Services Disclaimer: The App is provided "as is" and may be updated, modified, or discontinued at our discretion. We will provide reasonable notice for significant changes.

3. Eligibility

To use RentLink Mzansi, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the App under the laws of South Africa, Botswana, the United Kingdom, or your local jurisdiction.
• If listing properties as a landlord: have the legal right to rent or sublet the property.

4. User Accounts

4.1 Account Creation

To access the full features of RentLink Mzansi, you must create an account by providing accurate and complete information, including:

• Valid email address
• Full name
• Phone number
• Secure password

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorised access at support@zizweit.uk.
• Using a strong, unique password.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms.
• Post fraudulent or misleading property listings.
• Engage in harassment, abuse, or illegal activity.
• Remain inactive for extended periods (with prior notice).

You may terminate your account at any time by requesting deletion through the App or by contacting us at support@zizweit.uk. See our Account Deletion page for details.

5. Subscriptions and Payment

5.1 Subscription Plans

• Free trial: 1-month free trial for all new users.
• Tenant subscription: R20/month — browse properties, search, and unlock landlord contact details.
• Landlord subscription: R70/month — list and manage rental properties, receive tenant enquiries.

5.2 Automatic Renewal

• Subscriptions automatically renew at the end of each billing period.
• You will be charged the then-current rate unless you cancel.
• You can cancel at any time before the renewal date without penalty.
• Cancellation takes effect at the end of the current billing period.

5.3 Payment Processing

• Payments are processed securely through Google Play and/or RevenueCat.
• We do not store your full payment card details.
• By subscribing, you authorise the applicable payment processor to charge your payment method for all fees incurred.

5.4 Free Trials

• Free trial terms are stated at the time of sign-up.
• After the free trial ends, you will be automatically charged unless you cancel beforehand.

5.5 Refunds

• Refund requests are assessed on a case-by-case basis.
• We generally offer refunds within 14 days of initial purchase if you are dissatisfied with the service.
• No refunds are provided for partial subscription periods after 14 days.
• Refund requests processed through Google Play are subject to Google's refund policy.
• To request a refund directly, contact support@zizweit.uk with your order details.

5.6 Price Changes

• We may change subscription prices with 30 days' notice.
• Existing subscribers will be notified before any price increase takes effect.
• You may cancel before price changes take effect.

6. Acceptable Use Policy

6.1 You Agree To:

• Use RentLink Mzansi only for lawful purposes related to renting or listing rental property.
• Provide accurate and truthful information in all property listings and account details.
• Comply with all applicable laws and regulations, including South African and Botswana rental legislation.
• Treat other users with respect and professionalism.

6.2 You Agree NOT To:

• Post fraudulent, misleading, or inaccurate property listings.
• List properties you do not have the legal right to rent or sublet.
• Use the App to discriminate against prospective tenants in violation of applicable anti-discrimination laws.
• Share your account credentials with others.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Reverse engineer, decompile, or disassemble the App software.
• Transmit viruses, malware, or malicious code.
• Harass, abuse, or threaten other users.
• Collect or harvest user data without consent.
• Use the App for any purpose other than its intended rental marketplace function.

7. Property Listings and User Content

7.1 Content You Create

When using RentLink Mzansi, you may create the following content:

• Property listing descriptions and details.
• Property photographs and media.
• User profile information.
• Messages and communications with other users.

7.2 Content Responsibility

You are solely responsible for:

• The accuracy and completeness of your property listings.
• Ensuring your content does not violate laws or third-party rights.
• Having the legal right to list any property advertised.
• The accuracy of pricing, availability, and property condition details.

7.3 Content Licence

• Your Content: You retain ownership of all content you create using the App (e.g., listings, photos, descriptions).
• Licence to Us: You grant Zizweit a limited, non-exclusive licence to display and distribute your content as necessary to operate the App and provide the service.
• This licence ends when you delete your content or account.

7.4 Content Removal

We reserve the right to remove any content that, in our sole judgement:

• Violates these Terms or applicable law.
• Is fraudulent, misleading, or deceptive.
• Infringes on intellectual property or privacy rights.
• Is offensive, harmful, or inappropriate.

8. Property Marketplace Disclaimer

9. Intellectual Property Rights

9.1 Our Rights

All content, features, functionality, and intellectual property in RentLink Mzansi, including but not limited to:

• Software code and architecture
• User interface and design
• Logos, trademarks, and branding ("RentLink Mzansi", "Zizweit")
• Text, graphics, and images (excluding user-generated content)

are owned by ZIZWE IT LIMITED and protected by UK and international copyright, trademark, and other intellectual property laws.

9.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use RentLink Mzansi on your personal device for its intended purpose, subject to these Terms.

10. Service Availability and Modifications

10.1 Availability

• We aim for high availability but cannot guarantee uninterrupted access to the App.
• Scheduled maintenance will be announced in advance when possible.
• We are not liable for service interruptions caused by factors beyond our control (network outages, device issues, etc.).

10.2 Modifications

• We may update, modify, or discontinue features of the App at any time.
• Significant changes will be communicated with reasonable notice.
• Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Limitation of Liability

11.1 To the Maximum Extent Permitted by Law

ZIZWE IT LIMITED, its directors, employees, and affiliates shall not be liable for:

• Indirect, incidental, special, or consequential damages.
• Lost profits, data, or business opportunities.
• Financial losses arising from rental transactions.
• Property misrepresentations or disputes between users.
• Data loss due to device failure or user error.
• Service interruptions or unavailability.
• Actions of third-party service providers.

11.2 Liability Cap

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim, or R2,000 (ZAR), whichever is greater.

11.3 Exceptions

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless ZIZWE IT LIMITED from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms.
• Your use or misuse of RentLink Mzansi.
• Content you post or submit (property listings, photos, etc.).
• Violation of third-party rights.
• Disputes between you and other users of the App.

13. Data Protection and Privacy

Our collection, use, and protection of your personal data is governed by the RentLink Mzansi Privacy Policy, which forms part of these Terms. Key points:

• We comply with UK GDPR, EU GDPR, and South Africa's POPIA.
• We never sell your personal data.
• You have full rights to access, correct, and delete your data.
• You may request account deletion at any time — see Account Deletion.

14. Third-Party Services

RentLink Mzansi integrates with the following third-party services:

• Google Play / RevenueCat: Payment processing and subscription management.
• Supabase: Backend infrastructure and database.
• Sentry: Error tracking and crash reporting.
• PostHog: Usage analytics.

Use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party actions or failures.

15. Dispute Resolution

15.1 Informal Resolution

Before taking formal legal action, please contact us at support@zizweit.uk to resolve the matter informally. We aim to respond within 14 business days.

15.2 Governing Law

These Terms are governed by the laws of England and Wales. For RentLink Mzansi users in South Africa, the Consumer Protection Act (CPA) and Protection of Personal Information Act (POPIA) also apply where applicable.

15.3 Jurisdiction

Legal disputes shall be resolved in the courts of England and Wales. For users in South Africa, disputes may also be resolved in the courts of South Africa.

16. Termination

16.1 By You

• Cancel your subscription at any time through Google Play or by contacting us.
• Cancellation takes effect at the end of the current billing period.
• You may delete your account and data at any time via our Account Deletion page.

16.2 By Us

We may suspend or terminate your access immediately if:

• You violate these Terms.
• You post fraudulent or misleading property listings.
• You engage in illegal activity or harassment.
• Your account poses security risks to other users.
• Payment fails repeatedly.

16.3 Effects of Termination

• Access to the App and its features will cease.
• Your property listings will be removed from the platform.
• Personal data will be deleted within 30 days, except where retention is required by law.
• No refunds for partial subscription periods (except as required by law).

17. Changes to These Terms

We may update these Terms to reflect:

• Changes in the App's features or functionality.
• Legal or regulatory requirements.
• Changes in business practices or pricing.

We will notify you of significant changes via:

• In-app notifications.
• Email to your registered address.
• Updates on this page.

Continued use of RentLink Mzansi after changes constitutes acceptance. If you disagree with changes, you may cancel your subscription and delete your account.

18. Miscellaneous

18.1 Entire Agreement

These Terms, together with the RentLink Mzansi Privacy Policy, constitute the entire agreement between you and ZIZWE IT LIMITED regarding your use of the App.

18.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right.

18.4 Assignment

You may not transfer or assign your rights under these Terms. We may assign our rights to any successor or affiliate.

18.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, pandemics, power outages, government actions, or internet disruptions.
